Terms of Use
These terms cover this website. They are not the terms of any work we do for you, which live in a signed agreement and always take precedence over anything here.

What this site is
A description of what we do, what we have built, and what we think about the work. It is information, not an offer.
Nothing here is professional, legal, financial or technical advice for your specific situation, and nothing here creates a contract or a client relationship. Our published writing describes what we observed on particular engagements. It is not a prediction about yours.
Using the site
You are welcome to read it, share it, and quote from it with attribution and a link. We would rather the ideas travelled than sat here.
What we ask you not to do:
- Copy the site systematically, or scrape it at a volume that degrades it for anyone else.
- Republish substantial parts of it as your own work, or reproduce it wholesale to build a competing offering.
- Attempt to breach it, probe it or interfere with its operation. If you find a vulnerability, tell us and we will thank you for it.
- Use it to send unsolicited commercial mail to the addresses published on it.
Content and marks
The text, images, diagrams, interface designs and code on this site are ours or used with permission. The Novyant name and mark are ours. None of it transfers to you by your reading it.
Third-party names
Insurer, client and vendor names appear on this site as statements of fact about work we have done. Every one of those names and marks belongs to its owner, not to us.
In particular, the carriers listed on the claims management page are named because their claims are processed through a platform we built and operate. They are clients of the firms whose claims work runs on that platform, not clients of Novyant. Their appearance here is not an endorsement of Novyant by them, and no partnership, affiliation or approval should be inferred from it. Any of them may ask us to remove their name and we will.
Statements about what we have built
We label each product with its real maturity: in production, early access, or in development. Those labels describe the position on the date shown at the top of the page they appear on. They are not a commitment to a roadmap, a release date, or a feature that has not shipped.
Figures we publish about a deployment, such as claims processed per year or concurrent users, describe a system running now. They are not a capacity guarantee, a benchmark, or a prediction of what a different operation would see.
Booking a consultation
Submitting the consultation form and booking a call does not create a contract. It does not oblige us to take the work, and it does not oblige you to buy anything. Either of us can end the conversation at any point, and we will sometimes tell you the honest answer is that nothing should be built.
What is said on that call is a first view based on what you have described in an hour. It is not a professional opinion to act on without a written engagement behind it.
Client engagements
Actual work is governed by a signed services agreement and a statement of work covering scope, price, timeline, intellectual property, confidentiality, data handling and liability. Where anything in those documents conflicts with anything on this page, those documents win. These terms are about the website.
Links to other places
This site links out to third-party services, including LinkedIn and the Calendly booking calendar. We do not control them and we are not responsible for their content or their handling of your information. Their terms and privacy policies apply once you are there.
Availability and accuracy
We try to keep this site accurate and available, and we correct things when they are wrong. But it is provided as it is, without warranty of any kind, and we do not promise it will be uninterrupted, error-free, or current on any given day.
Limitation of liability
To the fullest extent the law allows, Novyant is not liable for any indirect, incidental, special or consequential loss arising out of your use of this site, or for any decision taken in reliance on it without a written engagement.
Nothing here limits any liability that cannot lawfully be limited, including liability for fraud or fraudulent misrepresentation.
Privacy
What this site collects, what it does not, and how to have it deleted are set out in the Privacy Policy, which forms part of these terms.
Changes to these terms
We may update these terms. The date at the top shows when they last changed, and the version published here is the one that applies.
Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Any dispute arising out of them or out of your use of this site is subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
